Product Sourcing & Human Rights

Product Sourcing & Human Rights Approach to Sourcing and Human Rights At Ross Stores, Inc. (“Ross”), which includes Ross Dress for Less and dd’s DISCOUNTS, ethical business practices are at the core of our culture and can be seen every day in the way we treat all of our constituents, from customers and associates to vendors and investors. This focus on ethical business practices is also reflected in Ross’ policy that we will not knowingly purchase merchandise from any manufacturer involved in the use of child, slave, prison or forced labor. Ross is an off-price retailer with 1,561 stores in 37 states, the District of Columbia, and Guam as of April 29, 2017. The majority of the apparel, footwear, accessories and home-related merchandise sold in our stores is purchased from suppliers after they have been produced and imported to other retailers’ specifications. Though Ross does not have direct control over the manufacturing processes for these products, we require suppliers to uphold our ethical standards, both contractually and through enforcement. While Ross orders and imports some products directly through its international buying agents and from manufacturers, they represent the minority of merchandise sold in our stores. For these items, we have additional requirements in place to monitor compliance. Ross’ standards and requirements related to sourcing and human rights are incorporated in various Company documents, including Ross’ Code of Business Conduct and Ethics, Vendor Compliance Manual, Purchase Orders, Vendor Indemnification Agreements, and Buying Agent Agreements. Our Code of Business Conduct and Ethics is located under Corporate Governance in the Investors section of www.rossstores.com, and our Vendor Compliance Manual can be found at partners.rossstores.com. Ross communicates its standards and requirements to vendors, buyers and international buying agents during our purchasing processes. Ross’ Sourcing and Human Rights Standards Vendors, manufacturers and other business partners of the Company are required to comply with all applicable federal, state, local and international laws relating to the manufacture and production of products sold to Ross, including compliance with all applicable laws relating to: labor compensation; working conditions; child, slave, prison or forced labor; environmental protection; product safety; corruption or bribery (including foreign corrupt practices); building and working condition safety; and similar obligations. Ross will not knowingly purchase any product whose manufacture involved the use of any child, slave, prison or forced labor; any labor where workers are not provided wages or safe working environments as required by law. Additionally, we will not knowingly purchase products made in violation of established environmental or consumer product safety requirements. To the extent contractors or subcontractors are involved in the production of goods supplied to Ross, vendors must ensure that these parties adhere to all applicable laws and regulations. Training and Enforcement of Ross’ Standards Ross provides initial training for new buying associates as well as ongoing training and updates to buyers and other associates involved in our product sourcing. Further, Ross’ Legal and Transportation departments monitor and assess our supply chain for compliance related to product safety, labor laws and human trafficking laws. For products sold in our stores for which Ross is the direct importer: Ross trains and instructs overseas buying agents, shippers, product testing lab resources and impacted Ross associates on Company standards and on policies and protocols relating to import products. Ross requires buying agents to conduct initial in-person walk-throughs and subsequent full inspections of vendor factories. Ross regularly reviews and audits buying agent inspection reports to verify that they are complete, comprehensive and up to date. Ross engages third-party auditors to conduct social compliance audits on certain vendor factories. Ross Legal team members observe and monitor select buying agent inspections and third-party audits of vendor factories. Ross tracks vendors’ corrective actions addressing any issues identified in buying agent inspections or third-party audits. Ross requires its international buying agents to request and review available third-party factory audit reports of direct import suppliers and to report and disclose any issues contained in those reports to Ross compliance personnel in the Legal department. If Ross becomes aware that any vendor has been found to be out of compliance with Ross’ requirements or procedures regarding the above, including any applicable local, national or international labor or human trafficking laws, Ross will take appropriate responsive action, which could include suspending all shipments of a vendor’s merchandise and terminating the business relationship.

Florida clarifies Covered Farm Vehicle exemptions and requirements for CDL and markings

Covered Farm Vehicles (CFV) The Moving Ahead for Progress in the 21st Century Act (MAP-21) and Fixing America’s Surface Transportation Act (FAST Act) include specific language related to vehicles transporting agricultural commodities and farm supplies. These Acts identify specific exceptions from the Commercial Driver’s License (CDL) requirements for “Covered Farm Vehicles” (CFV). The Florida Legislature, through Section 322.01, Florida Statutes (F.S.), and other sections within Chapter 322, F.S., adopted these definitions and exemptions for vehicles operating in Florida. What is a Covered Farm Vehicle? "Covered farm vehicle" means a motor vehicle, including an articulated motor vehicle, that — (A) Is traveling in the State in which the vehicle is registered or another State; (B) Is operated by— (i) A farm owner or operator; or (ii) A family member or employee of a farm owner or operator; (C) Is transporting agricultural commodities, livestock, machinery, or supplies to or from a farm or ranch; (D) Is not used in a for-hire motor carrier operation, except that the transport of a covered farm vehicle by a towaway motor carrier is not considered a for-hire motor carrier operation; (E) (i) Has a gross vehicle weight rating or gross combination weight rating, whichever is greater, of 26,001 pounds or less; or (ii) Has a gross vehicle weight rating or gross combination weight rating, whichever is greater, of more than 26,001 pounds and travels within 150 air miles of the farm or ranch for which the vehicle is being operated; and (F) Is not transporting placardable amounts of hazardous materials. Who is exempt from obtaining a Commercial Driver’s License (CDL)? Any driver of a Covered Farm Vehicle (CFV) with a Gross Vehicle Weight Rating (GVWR) or Gross Combination Weight Rating (GCWR) of 26,001 pounds or less, is exempt from the CDL requirements. Any driver of a Covered Farm Vehicle (CFV) with a GVWR or GCWR of more than 26,001 pounds, is exempt from the CDL requirements when transporting agricultural commodities, livestock, machinery or supplies to or from a farm or ranch, provided the vehicle is operated within 150 air-miles of the farm or ranch, by a farm owner or operator, or a family member or employee of a farm owner or operator. The driver must hold a Class E or higher driver license. Note: If the operator of a Covered Farm Vehicle is operating outside the 150 air-mile radius and the vehicle has a GVWR or GCWR of more than 26,001 pounds, the driver is not exempt from the CDL requirements and must possess the appropriate CDL for the vehicle being operated. Is a medical certificate required for a CFV operator? Drivers of Covered Farm Vehicles (CFV) are not required to hold a medical certificate if the vehicle is operated in accordance with the 150 air-mile exception. What about farm tags? Covered Farm Vehicles are not required to have a “farm” tag. However, if a farm tag is displayed on the vehicle, the vehicle is subject to the same exemptions (150 air-mile exception), for which it would be entitled if no farm tag was displayed. What is a “covered farm vehicle” marking? Section 316.302, F.S. requires a motor vehicle or combination of vehicles that has a gross vehicle weight rating or gross combination weight rating of more than 26,001 pounds and is operated as a covered farm vehicle, to be marked with a “covered farm vehicle” marking, to the front and rear of the vehicle or combination of vehicles. This marking must be readily visible and in a minimum of 2-inch lettering with a 1/2-inch brush stroke. Markings can be magnetic and removable. Examples of markings that meet the requirement of Section 316.302, F.S.: “Covered Farm Vehicle” “CFV” “Farm” “Farm Use” “Farm Vehicle” “Agricultural Vehicle” “Agricultural” “Agricultural Use”

Precautionary Boil Water Order Issued for All of Miami-Dade County

Alert: Miami-Dade County Water and Sewer Department Precautionary Boil Water Order for all of Miami-Dade County Miami-Dade County Water and Sewer Department (WASD) has issued a precautionary boil water order for all of Miami-Dade County. The order was issued following a drop in pressure in the water distribution system due to an electrical failure at the John E. Preston Water Treatment Plant. Precautionary boil water orders are issued when there is a potential for harmful bacteria and other microbes to enter the drinking water system due to a loss of pressure. Loss of pressure can be a result of a main break, a hurricane, or a power outage. All water used for drinking, cooking, making ice, brushing teeth, or washing dishes should be boiled. A rolling boil for one minute is sufficient. As an alternative, bottled water may be used. Water used for showering and bathing does not need to be boiled. It is safe to wash clothes and linens with water from the tap. The precautionary boil water order will remain in effect until two consecutive days of clear samples are returned, indicating the water is safe for consumption. WASD will provide updates as they become available. Customers with questions can contact the WASD Customer Service Center at 305-665-7477.

FLHSMV Clarifies Exemptions for Covered Farm Vehicles in Florida

Covered Farm Vehicles Certain drivers of covered farm vehicles are exempt from certain requirements of the Federal Motor Carrier Safety Regulations (FMCSRs). This means that they do not need to possess a commercial driver license (CDL) to operate covered farm vehicles and are exempt from certain recordkeeping and medical card requirements. The federal exemption applies to the following individuals: An operator of a covered farm vehicle, as defined in 49 CFR 390.5, who is not operating it for hire. A custom harvest operation, as defined in 49 CFR 390.5, when the vehicle is operated by a custom harvester or an employee of a custom harvester. Vehicles that meet the definition of a "covered farm vehicle" are those that: Are operated by a farm or ranch owner or operator, or an employee or a family member of a farm or ranch owner or operator; Transport agricultural commodities, livestock, machinery, or supplies to or from a farm or ranch; Are not used in a for-hire motor carrier operation, except for a custom harvest operation; Are not transporting placardable quantities of hazardous materials; And Are operated within the state of Florida or within 150 air miles of the farm or ranch.
