United States District Judge Adrienne Nelson
United States District Judge Adrienne Nelson U.S. District Court District of Oregon Mailing Address Mark O. Hatfield United States Courthouse 1000 Southwest Third Avenue, Room 1407 Portland, Oregon 97204-2944 Contact Information Chambers: 503-326-8350 Courtroom Deputy: 503-326-8355 Proposed Document Submissions: The e-mail address at this link is available for the receipt of submitted jury instructions and proposed forms of orders per LR 5 only and may not be used to submit filings. Unauthorized correspondence will be deleted. Opportunities for Young Lawyers Judge Nelson encourages litigants and law firms to be mindful of opportunities for young lawyers of all backgrounds (attorneys practicing less than 7 years) to conduct hearings before the court in tandem with more experienced attorneys, especially where young lawyers drafted or significantly contributed to motions and responses. These opportunities include oral argument as well as witness examination. Judge Nelson believes it is important to provide young lawyers with substantive speaking opportunities to gain experience in court, as the benefits of such experience accrue to the young lawyer, clients, and the legal profession in general. However, Judge Nelson understands that, in some instances, having a young lawyer appear may not be appropriate or in the client's best interest. Therefore, an experienced attorney may supplement a young lawyer's arguments and questions with their own if necessary. Judge's Copies of Filings Except for those documents identified in the Trial Management Order, parties are exempt from Local Rule 5-10 with regard to the paper filing of documents. PLEASE DO NOT SEND JUDGE NELSON PAPER COPIES OF YOUR FILINGS. SHE WILL ACCESS YOUR FILINGS ELECTRONICALLY AND DOES NOT NEED A COURTESY COPY. Courtroom Rules Wireless communication devices must be placed in silent mode while in the courthouse. Recording devices may not be used at any time in the courthouse or in any court proceedings conducted remotely using telephone conferencing, video conferencing, or any other form of electronic communication. The parties should provide advance notice when they require teleconferencing, intend to utilize the courtroom's video displays, or have other presentation technology questions. Attorneys and parties should conduct themselves with decorum and civility. This is primarily for their own benefit: jurors, courtroom staff, and public observers consistently state that they prefer a civil and collegial relationship between opposing parties and counsel. During oral arguments, attorneys and witnesses should refer to parties by their proper names (Ex: "Mr. Smith" not "the defendant"). Hyperlink The court strongly encourages counsel to hyperlink to the cases that they cite in their briefs. For more information on inserting hyperlinks in CM/ECF documents, see Section 5 of the CM/ECF User Manual. Expedited Case Management If the parties agree to an expedited trial schedule, the court will set a case management conference to discuss limits on discovery and the need for dispositive motions. The court will make every effort to set a trial date within six months of the expedited case management conference. Pro Se Parties Parties proceeding pro se (that is, representing yourself without a lawyer) should refer to the District of Oregon's Handbook for Self-Represented Parties for helpful information. Consent to Jurisdiction by Magistrate Judge To consent to jurisdiction by magistrate judge, each party must complete and file the Consent to Jurisdiction by a Magistrate Judge form. For more information see Consenting to the Jurisdiction of a Magistrate Judge in the District of Oregon. Judicial Externship Openings Judge Nelson is currently accepting applications for Summer 2026 and Spring 2027 judicial externs. Senior United States District Judge Marco A. Hernández
Senior United States District Judge Marco A. Hernández U.S. District Court District of Oregon Mailing Address Mark O. Hatfield United States Courthouse 1000 Southwest Third Avenue, Room 1507 Portland, Oregon 97204-2944 Contact Information Chambers: 503-326-8210 Courtroom Deputy: 503-326-8061 Proposed Document Submissions: The e-mail address at this link is available for the receipt of submitted jury instructions and proposed forms of orders per LR 5 only and may not be used to submit filings. Unauthorized correspondence will be deleted. Proposed Orders: Please do not file proposed orders (except for protective order or pretrial order) or judgments in ECF unless requested by Judge Hernández. If proposed documents are requested by Judge Hernández, they should not be filed, but should be emailed to the courtroom deputy in Word or WordPerfect format. Pro Se Parties: Parties proceeding pro se (that is, representing yourself without a lawyer) should refer to the District of Oregon's Handbook for Self-Represented Parties for helpful information. Motion for Extension of Time: Motions seeking an extension of time should be filed no less than seven days before the existing deadline. Discovery Issues: Judge Hernández urges parties to attempt to informally resolve discovery disputes. Pursuant to FRCP 16(b)(3)(B)(v), a party must request a conference with the Court before moving for an order relating to a discovery dispute. Parties may contact Judge Hernández's Courtroom Deputy to schedule an informal telephone conference or to submit an informal summary of the dispute for the Judge's consideration. Judge's Copies: Judge Hernández expects all CM/ECF Registered Users under Local Rule 5-1(a), to comply with Local Rule 5-10(a) which provides: Unless otherwise ordered by the Court, a paper copy, properly fastened pursuant to LR 10-1(e), of the following electronically filed documents, and the Notice of Electronic Filing, must be marked as a "JUDGE'S COPY" and delivered to the Clerk's Office within three business days after the electronic filing: Dispositive motions and motions for injunctive relief (including all related documents), Social Security administrative records, and any other documents (including all related documents) that, in the aggregate, are in excess of ten pages. Additionally, Judge Hernández prefers that any Judge's paper copy of a combined filing of two inches or more be placed in three-ring binder with tabs for all documents and exhibits. Parties filing objections to a Findings and Recommendation, or a response to such an objection, are expected to comply with Local Rule 5-10(a) as to the objection and the response, but they do not need to file Judge's copies of the Findings and Recommendation itself or the underlying briefing, which is already in the record. Oral Argument: Typically, oral arguments for dispositive motions are set at the Rule 16 conference, in advance of the actual filing of a dispositive motion. Judge Hernández may cancel a previously-set oral argument date for a dispositive motion if he determines oral argument is not necessary. For other motions, the parties will be notified if the Court requires oral argument. Expectations for Dispositive Motion and Trial Dates: Judge Hernández expects the vast majority of civil cases to be tried within 18 months of the date of filing. At a Rule 16 conference, case management dates will be set with this expectation in mind. The dispositive motion deadline is usually set for 30 days after the close of discovery and a trial date several months thereafter. Given the Local Rule regarding the timing of dispositive motion responses and replies, the time required for the Court to resolve the motion (with or without oral argument), and the time the parties need to have a decision on dispositive motions before a pretrial order or first wave of trial documents are due, it is highly unlikely that once set, a dispositive motion deadline can be extended without impacting the trial date. Therefore, motions to extend dispositive motions are looked upon unfavorably. Law Clerk Hiring: Judge Hernández is not hiring law clerks at this time. Judge Hernández hires one law clerk each year to serve a two-year term. To apply, submit cover letter, resume, law school transcript (unofficial is fine), writing sample (no more than five pages double-spaced; excerpts are fine), and two letters of recommendation to the Honorable Marco Hernández, U.S. District Court, 1507 U.S. Courthouse, 1000 SW Third Avenue, Portland, OR 97204. Applications must be received between February 15 and April 15. Applications will be reviewed shortly after the closing date with interviews typically held in mid to late May. Externships: Judge Hernández also accepts applications for full-time judicial externships. We seek a diverse pool of applicants, regardless of class rank or GPA. Applicants must have a good work ethic, a willingness to learn, and completed their 1L year. Apply by January 31 for the following summer, fall, and spring semester positions. Submit a cover letter, resume, law school transcript (unofficial is fine), writing sample (no more than five pages double-spaced; excerpts are fine), and names of three references to the Honorable Marco Hernández, U.S. District Court, 1507 U.S. Courthouse, 1000 SW Third Avenue, Portland, OR 97204. All submissions must be in hard copy only. Applications will be reviewed immediately following the deadline, and interviews will occur shortly thereafter. Courtroom Rules: Mobile devices must be turned off before entering the courtroom. Please provide advance notice when you require teleconferencing, intend to utilize the courtroom's video displays, or have other presentation technology questions. Attorneys and parties should conduct themselves with decorum and manners. This is primarily for your own benefit: jurors, courtroom staff, and public observers consistently state that they prefer a civil and collegial relationship between opposing parties and counsel.
United States Magistrate Judge Andrew D. Hallman
United States Magistrate Judge Andrew D. Hallman U.S. District Court District of Oregon Address: John F. Kilkenny United States Courthouse 104 Southwest Dorion Avenue, Second Floor Pendleton, Oregon 97801-0808 (Courthouse not staffed) Contact Information: Courtroom Deputy: 503-326-8061 Proposed Document Submissions: The e-mail address at this link is available for the receipt of submitted jury instructions and proposed forms of orders per LR 5 only and may not be used to submit filings. Unauthorized correspondence will be deleted. Rule 16 Conferences: Judge Hallman sets Rule 16 conferences after all defendants have answered. The parties should be prepared to discuss scheduling at the Rule 16 conference. Before the conference, the parties shall consult with each other pursuant to Rule 26(f). The parties are encouraged to e-mail a joint proposed case management schedule to Judge Hallman's Courtroom Deputy in advance of the Rule 16 conference. Discovery: Judge Hallman handles discovery matters informally and discourages formal motions to compel, which take extra time and resources to resolve. If the parties have a discovery dispute, they should jointly e-mail Judge Hallman's Courtroom Deputy at the e-mail address above, and the matter will be quickly set for a telephonic hearing. If the parties anticipate they will need Judge Hallman's assistance in resolving a deposition dispute, they should contact Judge Hallman's Courtroom Deputy to advise her of the upcoming deposition date and time. Motion Hearings: Judge Hallman will generally permit oral argument on all dispositive motions. Judge Hallman's preference is to conduct oral argument in person at the Kilkenny Courthouse in Pendleton. However, the Court will consider requests to hold oral argument by video or telephone upon a showing of good cause. Examples of good cause include significant travel expense for the parties, health and safety concerns, or unavoidable scheduling conflicts. Parties requesting oral argument should contact Judge Hallman's Courtroom Deputy for scheduling and, if applicable, include a request to schedule by phone or video. Summary Judgment: Judge Hallman strongly encourages parties to only seek summary judgment on issues that involve no question of material fact or that raise significant dispositive legal issues, so as to avoid unnecessarily delaying the resolution of the case and wasting client's money and the court's resources. Accordingly, a moving party's argument in favor of summary judgment should be well supported by citations to the record, which should be either to the paragraph numbers of affidavits and declarations or to the page number of any deposition excerpts. Parties are required to submit copies of all documents in an organized fashion. Judge's Copies: Judge Hallman waives Local Rule 5-10 and does not require paper copies of any documents filed for his consideration. Note that the rule is not waived for documents filed in Judge Hallman's cases if those documents will be considered by another judge (unless that judge similarly waives the rule). Pro Hac Vice Counsel: Attorneys admitted pro hac vice and their Oregon counsel should read and be familiar with the court's Local Rules, and with "The Integral Role of Local Counsel in the District of Oregon," Federal Bar Association, Oregon Chapter newsletter, Summer 2013. Settlement Conferences: Requests to schedule a settlement conference with Judge Hallman should be directed to Judge Hallman's Courtroom Deputy. Opportunities for Young Lawyers: Judge Hallman strongly encourages litigants and law firms to be mindful of opportunities for young lawyers (attorneys practicing less than 7 years) to conduct hearings before the court in tandem with more experienced attorneys, especially where young lawyers drafted or significantly contributed to motions and responses. These opportunities include oral argument as well as witness examination. Judge Hallman believes it is important to provide young lawyers with substantive speaking opportunities to gain experience in court, as the benefits of such experience accrue to the young lawyer, clients, and the legal profession in general. However, Judge Hallman understands that, in some instances, having a young lawyer appear may not be appropriate or in the client's best interest. Therefore, an experienced attorney may supplement a young lawyer's arguments and questions with their own if necessary. Expedited Case Management: If the parties consent to Magistrate Judge and agree to an expedited trial schedule, the court will set a case management conference to discuss limits on discovery and the need for dispositive motions. The court will make every effort to set a trial date within six months of the expedited case management conference. Pro Se Parties: Parties proceeding pro se (representing yourself without a lawyer) should refer to the District of Oregon's Handbook for Self-Represented Parties for helpful information. Courtroom Rules: Pursuant to LR 83-14, wireless communication devices must be placed in silent mode while in the courthouse.
