The Mulberry City Commission approved procedural guidelines for an agreement at its Sept. 15 meeting, establishing how parties must notify each other of address changes.
Notice takes effect when delivered by hand or fax, or three days after mailing. The agreement binds only the named parties and grants no rights to third parties.
Amendments in Phase 1 require all parties' written consent. Phase 2 allows specific sections to be amended by relevant project participants, while other provisions need approval from all original parties. A party's failure to exercise a right does not waive other rights unless the agreement states otherwise.
If a court voids a provision, it is deleted without invalidating the rest of the agreement. If the deleted provision is essential, the parties must agree on a replacement within 90 days or the agreement terminates.
