Annexation

Annexation Overview Annexation is the process of making a property part of a municipality. Properties that are contiguous to the city's municipal boundaries and seek a connection to city utilities must annex the property prior to or concurrent with connection to the city's utilities, except for in the North Peninsula Water District. The North Peninsula Water District (Ormond-by-the-Sea) was established in 1979 by Ordinance No. 79-45 (Article I, Division 3, Chapter 22, Code of Ordinances) and does not require annexation nor an annexation agreement for connection to Ormond Beach utilities. Properties outside the North Peninsula Water District and not contiguous to the city's municipal boundaries are required to enter into an annexation agreement at the time the property becomes contiguous in order to receive Ormond Beach utilities. Utility Connection Policy for the North Peninsula Water District (Ormond-by-the-Sea) On October 1, 2019, the City Commission adopted Resolution No. 2019-184 reaffirming the long-established historical policy regarding the provision of potable water service to properties in the North Peninsula Water District, and stated that neither annexation nor the execution of an annexation agreement shall be required as conditions to connect to the city's potable water system. The Resolution states that in the event that the City Commission determines to provide centralized wastewater (sewer) services to properties in the North Peninsula Water District, the City Commission expressed their intention to not require property owners in that service area to annex their property or to sign an annexation agreement as a condition to receiving centralized wastewater (sewer) services. Amendments to the city's Comprehensive Plan, Land Development Code, and Code of Ordinances to clarify the city utility connection policies are in process.
