With prom season and summer approaching, local law enforcement agencies, including the Tampa Police Department and the Hillsborough County Sheriff's Office, are reminding the community about the state's strict 'Zero Tolerance' policy for drivers under 21.

Under Florida Statute 322.2616, any driver under the age of 21 found with a blood alcohol content (BAC) of 0.02% or higher will have their driver's license immediately suspended for six months. This is a significantly lower threshold than the 0.08% BAC limit for drivers 21 and older, reflecting the state's zero-tolerance stance on underage drinking and driving.

For a first offense, in addition to the six-month license suspension, the driver may be required to complete a substance abuse course. If the BAC is 0.05% or higher, the suspension remains in effect until the individual completes a substance abuse course and an evaluation, and if recommended, completes treatment. Refusal to submit to a breath, blood, or urine test also results in an automatic one-year license suspension.

Repeat offenses carry even harsher penalties. A second underage DUI conviction within five years results in a one-year license suspension. Beyond the administrative penalties, underage drivers can also face criminal charges if their BAC is 0.08% or higher, or if they show signs of impairment, leading to potential fines, probation, community service, and even jail time, depending on the circumstances.

These laws are in place to deter underage drinking and driving, aiming to keep Tampa's roads, including scenic Bayshore Boulevard, safer for everyone. Local schools, like those in the Hillsborough County Public Schools district, often incorporate educational programs about the dangers and legal repercussions of underage DUI as part of their curriculum, particularly for high school students. Parents are encouraged to discuss these serious consequences with their children to prevent tragic incidents and ensure a safe community.
