Local family law attorneys report a growing trend where posts, photos, and messages from sites like Facebook, Instagram, and even TikTok are being presented as evidence in court.

"It's become almost standard practice," explains Sarah Jenkins, a family law attorney with Jenkins & Associates on Kennedy Boulevard in downtown Tampa. "What people share online, even if they think it's private or deleted, can be discovered and used to establish patterns of behavior, financial disclosures, or even parental fitness."

The types of information being sought range from vacation photos that contradict claims of financial hardship, to posts detailing new relationships that could impact alimony or child custody arrangements. Attorneys are advising clients to be acutely aware of their online presence from the moment divorce becomes a consideration.

"We tell our clients in Tampa to assume anything they post online could end up in front of a judge," says Michael Rodriguez, a partner at Rodriguez Legal Group near the Hillsborough County Courthouse in downtown Tampa. "Even seemingly innocuous comments or likes can be taken out of context or used to build a narrative."

This trend underscores the importance of digital literacy and caution for anyone undergoing or contemplating divorce. Legal experts suggest reviewing privacy settings, refraining from posting about the divorce or ex-spouse, and being mindful of what friends and family might post that could involve them.

As technology continues to evolve, so too does its impact on legal matters. For Tampa families, understanding the implications of social media in divorce is no longer just good advice, but a critical component of navigating the legal process.
