Maitland Launches Vested Rights Determination Checklist for Developers

Maitland property owners and developers pursuing projects in the city must now adhere to a specific Vested Rights Determination Submittal Checklist. This checklist ensures all necessary documentation and information are provided when claiming vested development rights.

The city requires a complete online application and payment of the associated fee. Applicants must also provide authorization for any agent representing the property owner, including the agent's name, address, and phone number. All supplemental information must be compiled into a single PDF document for submission.

Key documentation includes proof of property ownership, such as a title opinion from a Florida attorney or an abstract of title. This ownership evidence must cover the period from the date of notice of a land development regulation change until at least two weeks prior to the special permit application date. A boundary survey and legal description, prepared and sealed by a Florida-registered surveyor, are also essential for the parcel where vested rights are claimed.

Applicants must sign an affidavit under penalty of perjury before a notary public, attesting to the truth and accuracy of the application and all attachments. A detailed recital of facts is also mandatory. This recital must include specific dates and dollar amounts of expenditures or obligations to expend funds, the nature of these expenditures, and any other factors supporting the claim for a vested right to commence and complete a specific level, type, nature, density, intensity, or other form of development.

The Zoning Administrator may specify additional information relevant to the standards and factors outlined in this section.
