However, businesses that choose to adopt policies compliant with the Drug-Free Workplace Act can benefit significantly. These benefits include potential discounts on workers' compensation premiums. Furthermore, such compliance may allow an employer to deny workers' compensation benefits to an employee who refuses a drug or alcohol test, or who tests positive for drugs or alcohol following a workplace injury that leads to a workers' compensation claim. These provisions are outlined in Sections 440.101(2) and 440.102(2) of the Florida Statutes.

Beyond state law, drug and alcohol testing can also intersect with federal regulations, specifically the Americans with Disabilities Act (ADA). Under the ADA, any disability-related inquiries or medical examinations of employees must be "job-related and consistent with business necessity." This standard would apply to tests like blood, urine, or breath analyses for alcohol use, as alcoholism is recognized as a disability under the ADA. Conversely, tests designed to detect the current illegal use of drugs do not need to meet this stringent standard, as illegal drug use is not protected under the ADA.
