To qualify for this protection, the property must be the homeowner's primary residence, meaning they must live on the property with the intention of making it their permanent home. Homeowners must also hold legal or equitable title to the property.

The homestead exemption applies to up to one-half acre of land within a municipality, such as Davie, or up to 160 acres of contiguous land outside a municipality. These limits cover not only the dwelling but also the surrounding property essential for the homeowner's use and enjoyment, including stables and pastures in Davie's equestrian communities.

This protection generally shields a homeowner's equity from creditors for debts like credit card debt, personal loans, or judgments. However, there are important exceptions. The exemption does not protect against foreclosure if a homeowner defaults on their mortgage payments. Similarly, liens for unpaid property taxes can lead to the forced sale of a home, as can mechanics' liens from unpaid contractors who performed work on the property. Voluntary liens, such as those from home equity loans where the home is used as collateral, are also not covered if the homeowner defaults.

While robust, the homestead exemption is not unlimited. The amount of protected equity can be capped in situations involving fraud. It also does not protect against debts from federal tax liens or criminal restitution orders.

To claim the homestead exemption, Davie homeowners must file an application with the Broward County Property Appraiser. This application typically requires documentation such as proof of ownership, proof of residency, and Social Security numbers. The deadline for filing is usually March 1st of each year.

Understanding these requirements, limitations, and benefits is crucial for Davie homeowners looking to protect their most valuable asset and maintain financial stability.
