Bay Harbor Islands Clarifies Right-of-Way and Traffic Permit Requirements for Construction

Bay Harbor Islands residents and contractors undertaking work within the Town's right-of-way, including roads and sidewalks, must secure both a Right-of-Way (ROW) Permit and a Maintenance of Traffic (MOT) Plan. These permits ensure safety and proper traffic flow during construction activities.

The MOT Plan must adhere to the latest edition of the Florida Department of Transportation's (FDOT) Design Standards and Part 6 of the Manual of Uniform Traffic Control Devices (MUTCD) for Streets and Highways. Applicants bear responsibility for ensuring compliance with the approved MOT plan, which must remain on-site throughout the entire construction period.

Required materials for the MOT Application include an MOT Plan overlaid on a color aerial map, FDOT Index Drawing(s) or MUTCD Typical Applications for detours, and copies of certifications for Traffic Control Technicians or Traffic Control Supervisors. Work on 96th Street (Kane Concourse) also requires state approvals.

Applicants should fill out both the ROW Permit and the MOT Application Form. Incomplete forms will not be processed. Completed ROW Permits and MOT Applications should be emailed to [email protected].

Initial permit approval may take up to 10 business days after Town Staff receives all required documents. Corrected resubmissions of rejected forms are considered new applications and may require up to 5 business days for approval. More complex plans may require additional time for coordination and information.
