Board of Adjustment | Fairbanks North Star Borough, AK Skip to Main Content Home Government Boards & Commissions Board of Adjustment Board of Adjustment Mission The Board of Adjustment hears appeals of Platting Board decisions in accordance with FNSB Code 17.68.010 and Planning Commission determinations on requests for conditional uses and variances, and of decisions or determinations made by the Department of Community Planning in the enforcement of FNSBC Title 18. The Borough Assembly sits as the Board of Adjustment or the Board may designate an appeals officer to hear a case. Standard of Review / How the Board of Adjustment "Hears" an Appeal The Board hears and decides appeals on the record, meaning no new evidence, testimony, or changed circumstances are heard by the Board. When considering an appeal, the Board schedules a hearing open to the public to review and discuss an appeal packet which contains specific information about the case. Summary of Appeal Process Title 17 appeals must be filed within 7 days of the date of the decision. Title 18 appeals must be filed no later than 15 days after the date of notification of a decision To file, submit a completed Notice of Appeal form to the Borough Clerk's Office along with a $75 non-refundable filing fee and $200 cost bond. Cost bonds are refunded to the appellant in the event the Board reverses, or partly reverses, the decision being appealed. The Clerk's Office will prepare an appeal record consisting of verbatim transcripts of any previous proceedings, copies of all documentary evidence and copies of the written decision being appealed. It is the responsibility of the appellant to arrange and pay for the preparation of a transcript by a court reporter. After the Record is complete, a period of written argument begins. The appellant will have an opportunity to file a written brief in support of their appeal, and the appellee will have an opportunity to rebut that with a written brief of their own. The appellant will then have a final opportunity to provide a written reply to the appellee's brief. An appellee brief may also be filed by, among others, any person who would be aggrieved if the decision of the lower administrative body were reversed. To participate in the process as an appellee, a form called Notice of Intent to File a Brief must be submitted to the Borough Clerk's Office within 20 days after the date of notification of the decision that is being appealed. The Clerk's Office will prepare an appeal packet consisting of the appeal record plus any written arguments and schedule a hearing date. Only the material contained in the appeal packet is considered by the Board. The board reviews the appeal packet and issues its decision. Written notification of the decision is sent to the appellant and appellee(s). Ex Parte Contact Prohibited Ex parte contact with the Board of Adjustment is when an appellant or appellee contacts the Board without the other party's knowledge, this includes but is not limited to contact in person, by phone, e-mail or text. Board members shall be impartial in all matters, both in fact and appearance. No board member shall receive or engage in ex parte contacts. All contact with the Board of Adjustment shall go through the Borough Clerk's Office. INVITATION TO BID: SCOW BAY BOAT HAULOUT
Notice is hereby given that the Petersburg Borough will receive sealed bids for the Scow Bay Boat Haul Out project. This project generally consists of the installation of shot rock embankment, armor rock, base course, concrete haul out ramp, timber boarding float, steel piles, concrete wash down pad, storm drains, water services, gravity and pressure sewer lines, sewer pump station, power pedestals, area lighting, wood framed utility building, coordination with local utilities, and other miscellaneous work. The estimated construction cost is between $12M and $15M. All Work must be substantially complete by May 1, 2028. The project is funded by local, state and federal resources, each with specific contract requirements. All bids must be electronically submitted through Bidexpress.com no later than 2:00 p.m. prevailing time on Tuesday, October 27, 2026 at which time the bids will be publicly opened and read aloud in the Borough Assembly Chambers and via Zoom (Meeting ID: 847 0096 2003 Passcode: 130504). The Petersburg Borough Standard Specifications, 2012 (PBSS) are available in printed format for a fee of $60.00 made payable to the Petersburg Borough. PBSS are also available for free download on the Borough’s website. Each bid shall be accompanied by a bid bond, cashier’s check or certified check made payable to the Petersburg Borough in the amount of five percent of the total bid price. Prospective bidders are encouraged to attend a Pre-Bid Conference that will be held in Petersburg on Thursday, October 8, 2026 beginning at 1:00 PM. The meeting may be attended in person at the Borough Assembly Chambers, or by Zoom. To attend the Pre-Bid Conference via Zoom (Meeting ID: 896 4087 2832 Passcode: 683122). Questions regarding this project must be submitted though the Bid Express.com service, seven days prior to bid opening. Questions received by phone, email or other means will not be answered. The Petersburg Borough reserves the right to reject any or all bids, to waive any informality in a bid, and to make award to the lowest responsive, responsible bidder as it may best serve the interest of the Borough. Please take notice that the Central Council of the Tlingit & Haida Indian Tribes of Alaska (CCTHITA) has filed an appeal from the Platting Board’s September 8, 2026 denial of its Application for a Minor Subdivision relating to the following real property: A portion of US Survey 1168 The Petersburg Borough Assembly, acting as the Board of Adjustment, will meet on Monday, October 5, 2026, at 11:30 a.m., in the Assembly Chambers of the Municipal Building located at 12 S. Nordic Drive, for the purpose of hearing and considering the appeal.
