Bradenton Mandates Non-Conversion Agreements for Floodplain Builds

BRADENTON, FL – The City of Bradenton now requires property owners to sign a Non-Conversion Agreement when building or improving structures in flood-prone areas. This agreement, a condition for obtaining building permits, specifically addresses flood-prone enclosures below the design flood elevation.

The agreement mandates that owners acknowledge covenants, conditions, and restrictions designed to mitigate flood damage. These stipulations ensure enclosed areas below the lowest floor are used appropriately and built to withstand potential flooding.

Key requirements include that interior walls, ceilings, and floors below the design flood elevation must be unfinished or made of flood-resistant materials. Mechanical, electrical, and plumbing devices cannot be installed below the lowest floor. Enclosed areas must also have functional flood openings that operate automatically.

Owners must limit the use of these flood-prone enclosed areas to parking, storage, or building access. Any other use violates the City of Bradenton's Floodplain Management Ordinance.

The city may pursue legal action to correct violations. Alterations made without a building permit break the city's floodplain ordinance and the Florida Building Code. These violations can make a structure uninsurable or significantly increase flood insurance costs.

The initiative aims to protect property owners and the community by enforcing floodplain management standards. Owners seeking permits for construction or improvements in designated flood zones must sign and record the agreement, binding themselves and future owners to these flood-resistant practices.
