Bradenton Enforces New Pool Safety Rules for Residents

Bradenton residents building new swimming pools, spas or hot tubs must now meet updated safety regulations aimed at preventing accidental drownings. The City of Bradenton Building Division is enforcing requirements from Chapter 515, Florida Statutes, and the Florida Building Code (FBC) Residential 8th Edition (2023).

New regulations mandate a secure barrier that completely surrounds any new pool or spa, preventing access from the residence or yard. According to FBC Residential 8th Edition Section R4501.17.1, this barrier can be a fence, a dwelling wall, a non-dwelling wall or a combination.

Homeowners using a dwelling wall as part of the barrier must install exit alarms on all doors and windows with direct access to the pool. These alarms must meet a minimum sound pressure rating of 85 decibels at 10 feet, certified by UL 2017. Alternatively, doors must have self-closing, self-latching devices with latches positioned at least 54 inches from the door bottom.

An approved safety pool alarm, designed to sound upon unauthorized entry, is another compliance option. These alarms must meet ASTM Standard F2208, "Standard Safety Specification for Residential Pool Alarms." Homeowners may also install an approved safety pool cover that complies with ASTM F1346-91, "Standard Performance Specifications for Safety Covers for Swimming Pools, Spas and Hot Tubs," as detailed in FBC Residential 8th Edition Section R4501.17.

Failure to install required safety measures by the final inspection constitutes a violation of Chapter 515, Florida Statutes. This misdemeanor offense carries penalties of up to a $500 fine and/or 60 days in jail, as per Chapter 775, Florida Statutes.
