Bradenton Building Permits Now Require Asbestos Notification

The City of Bradenton's Building Division now requires an asbestos notification statement with all building permit applications for demolishing or renovating existing structures. This measure ensures compliance with federal, state, and local asbestos regulations.

Applicants who sign construction applications and permits certify their compliance with all asbestos regulations. Failure to comply can lead to significant penalties. These include monetary fines for building owners, lessees, and their contractors. Violations may also result in criminal prosecution under federal law and the suspension or forfeiture of contractor licenses under state law.

The Florida Building Code, Chapter 1, Section 105.9, mandates this notification. The code requires that each permit for demolition or renovation of an existing structure include a statement confirming the owner's or operator's responsibility to comply with Section 469.003, Florida Statutes. It also requires notification to the Department of Environmental Protection for planned asbestos removal, aligning with state and federal law.

Regulations also detail licensing requirements for asbestos-related activities. Individuals performing asbestos surveys, developing operation and maintenance plans, or monitoring asbestos abatement must be trained and licensed as asbestos consultants. Preparing asbestos abatement specifications also requires an asbestos consultant license. Asbestos abatement work itself must be performed by licensed asbestos contractors.
