Code Compliance Department In an effort to keep our community attractive and encourage high property values, continual patrols by Code Compliance personnel are intended to insure that residents and business owners comply with codes and ordinances of the Town. At the present time, the Town has two Code Compliance Officers. The Code Officers regularly patrol the Town, research complaints, and enforce building and zoning codes. Code compliance assistance may be obtained by calling the office at 305-993-1786. You may also contact our officers directly: Code Compliance Manager Evelyn Merizalde at (786) 256-4347 for matters in the Business District and properties located on the East and West Islands South of Kane Concourse. Code Compliance Officer Scherrie Griffin at (786) 792-9619 for properties located on the East and West Islands North of Kane Concourse. Mission Statement The mission of the Code Compliance Department is to promote voluntary compliance with the Code of Ordinances of the Town of Bay Harbor Islands. We achieve this goal by vigilantly monitoring the appearance of our community and taking appropriate action as necessary. Our department serves our community further by educating our citizens and visitors alike in public safety issues; further, we work together with other agencies to help maintain the quality of life of this vibrant community. Enforced Requirements The complete Code of Ordinances of the Town may be accessed at Municipal Code Corporation, but the following is a sample of some of the Code requirements enforced by our Code Compliance Department: Animal Control - The Town code requires that all dogs, when not on the premises of the owner or the person in control of the dog, must be on a leash under control of a competent person. Furthermore, it is unlawful for any person in control of any dog to fail to remove fecal matter of the dog from any public property or any private property not belonging to the owner or person having custody of the dog. Any deteriorated items, such as: Any Deteriorated Part of Structures to the Extent It Causes a Blight on the Neighborhood or Endangers Life or Property including Driveways, Exterior Doors, Exterior Paint, Fascia Boards, Fences, Garbage Containers, Landscaping, Parking Areas, Railings, Roofs, Screens, Shutters, Swimming Pools and Pool Area, and Windows. Eyesore or areas of blight, such as litter or junk storage on property that is within view of the public or neighboring properties. Eyesore Vehicles - Town Code prohibits "eyesore" vehicles and such vehicles can be ticketed or removed by the Town after proper notice. An eyesore vehicle is defined as: wrecked, or partially dismantled, rusted through the metal, has missing or broken body parts, has parts attached with or covered by tape, unrepaired damage over 10% or more of the vehicle, or perhaps is covered with more than three different colors of paint. Noise Regulations - Construction, and other types of noises, are allowed on weekdays from 9 a.m. until 6 p.m. Construction is not allowed on Saturdays, Sundays or holidays unless special approval is received by the Town Manager prior to the work being done. To receive an application to perform work after these hours, contact the Building Department at 305-993-1786. Seawalls and Docks - The Town Council recently commissioned an engineering inspection to identify deficiencies as well as assess the condition of seawalls and docks in the Town. The report covered the Causeway Island, East Island and West Island and it categorized each seawall as good, satisfactory, fair, poor, serious or critical. You will be receiving a letter from the Town's Code Compliance Department advising you of your property's condition. Depending on the condition of your seawall and/or dock, a more detailed inspection and repairs might be recommended. On March 14, 2016, the Town Council of the Town of Bay Harbor Islands passed Ordinance 989, establishing a Sustainable Building Program, the purpose of which is to establish goals, programs and procedures that will help the Town become a more sustainable community. A pivotal part of this program is the voluntary participation of parties engaged in residential or commercial construction interested in seeking sustainable building certification, as per the published LEED standards of the USGBC, FGBC green building standards, GBI's Green Globes rating system, Energy Star standards, or similar state or nationally recognized program certification standards. For any program participant seeking said sustainable building certification, the following incentives shall be made available: Rebate of permit fees - Building permit and plan review fees shall be rebated upon certification of sustainable building program projects, including one-and two-family residential projects, and remodeling projects that meet the certification requirements of USGBC, FGBC, GBI's Green Globes, or Energy Star. Proof and verification of certification shall be required as a condition of the rebate of fees by the Town and shall be submitted to the town within 120 days of issuance of a certificate of occupancy or certificate of use to be eligible. Rebates shall be provided pursuant to the following schedule: - A rebate of 30% of paid permit and plan review fees for FGBC "Gold," USGBC "Platinum," or four Green Globes certification; - A rebate of 20% of paid permit and plan review fees for FGBC "Silver," USGBC "Gold," or three Green Globes certification; - A rebate of 10% of paid permit and plan review fees for FGBC "Bronze," USGBC "Silver," or two Green Globes certification; and Green building award. For the purpose of publicly recognizing outstanding commitment to "green building and construction practices" the sustainable building program shall provide for an award of a framed Town proclamation to be awarded annually to each program participant receiving a recognized certification. Recognition. The Town shall coordinate a program of recognition, on the Town website or through other additional means, identifying participating sustainable building projects. Signage. A builder may install one additional temporary construction sign, not to exceed 24 square feet in area that notes: "This project is a Town of Bay Harbor Islands Green Certified Project by (Company Name)" and/or "Certified Florida Yards and Neighborhoods." A developer of a commercial project may add the notation, "Town of Bay Harbor Islands Green Certified Project" in four-inch letters on permitted project entry and identification signs.
