Sanibel City Council approved Ordinance 26-012, a new measure addressing improper water discharge on the island. The ordinance, considered at the June 16, 2026, City Council meeting, amends several sections of the City's Code of Ordinances to regulate the draining of pools, spas, and other non-stormwater discharges.
The new regulations aim to protect Sanibel's water quality and environment, which faced significant challenges following Hurricane Ian's landfall on September 28, 2022. The hurricane caused catastrophic flooding and widespread damage, leading to extensive reconstruction and redevelopment activities. These efforts increased the frequency of pool draining, site dewatering, and groundwater pumping.
City officials identified recurring issues with the improper discharge of chlorinated pool and spa water, sediment-laden construction dewatering effluent, and other non-stormwater discharges. These materials entered canals, ponds, swales, stormwater infrastructure, and adjacent properties, creating adverse impacts on water quality, environmental resources, public infrastructure, and neighboring properties.
Ordinance 26-012 specifically amends Chapter 30 (Environment) and Chapter 70 (Utilities) of the City's Code of Ordinances. It adds a new Section 30-38 to address the unlawful draining of pools and spas and introduces Section 70-86 concerning illicit discharge within the sanitary sewer system. The ordinance also includes amendments to Section 30-39 regarding unlawful dumping into water storage areas and modifies Sections 70-103 (Definitions) and 70-112 (Unlawful Connection) related to the sewer system.
The City Council's approval of this ordinance means new rules are now in effect for residents and contractors involved in activities that generate water discharge. These changes aim to mitigate environmental damage and ensure responsible water management practices as the island continues its recovery and rebuilding efforts.
