The Osage County Attorney's Office diversion program is intended to give a "second chance" to offenders who commit a relatively minor criminal or traffic offense. Diversion is a privilege and not a right. There is no guarantee diversion will be granted in any given case. The needs of the offender are less important than those of public safety and the rights of the victim(s). In determining whether to grant diversion, the County Attorney will consider if the defendant demonstrates a genuine sense of remorse and is prepared to acknowledge the act(s) charged and the accountability for the consequences of their actions.

The following downloadable documents outline diversion policies: Adult Policy, Traffic Policy, and Juvenile Policy. Diversion application forms must be filled out completely and submitted to the Osage County Attorney's Office. Available applications include: Adult Application (Includes DUI offenses), Traffic Diversion Application, Juvenile Application, and Español - Acuerdo de desvío. IMPORTANT: Please do not pay the District Court before the diversion is filed. This will void your diversion and go down as a guilty charge. If you choose to pay online, you must make special arrangements with the Osage District Court to pay their portion; the County Attorney's portion can be paid online. If using mail, please mail both the County Attorney's payment and the District Court's payment together. Payment methods accepted: money order, bank check, or personal check. Please note that if your personal check bounces your diversion will automatically be rejected. Cash in person is also accepted, but there must be exact change for both payments. Online payment is available through https://www.govpaynow.com/gps/user/cyg/plc/a005ny with an associated fee. Additional resources include: Adult/Juvenile Diversion Helpers, Adult Community Service Log, ADSAP/RADAC Document List, Batterer's Intervention Programs Document List, Community Service Locations, and JV Community Service Log. For questions regarding diversion, call (785) 828-4931. Updated 12/16/2025.
