FDA Proposes Rule to Enhance Oversight of Foreign Tobacco Products

The U.S. Food and Drug Administration (FDA) has introduced a proposed rule to enhance its authority over foreign tobacco product manufacturers. This regulation aims to allow the agency to refuse entry of tobacco products that do not comply with U.S. requirements.

Regulators currently block products if a foreign facility has not registered with the FDA or has not submitted a product listing. The new proposal would expand this authority. The FDA could refuse entry of products from foreign manufacturers who fail to register their facilities, list their products, or appoint a U.S. agent.

This proposed rule also grants the FDA the ability to refuse entry of products that appear misbranded or adulterated under the Federal Food, Drug, and Cosmetic Act. Additionally, the agency could block products whose manufacturers fail to provide requested records, or if the products lack required marketing authorization.

Principal Deputy Commissioner Namandjé Bumpus stated, "Unauthorized tobacco products, particularly flavored e-cigarettes, continue to appear in the U.S. marketplace." Bumpus added that the FDA needs to use all available tools to remove these illegal products. She emphasized the importance of ensuring that all tobacco products undergo agency review and authorization before distribution or sale in the U.S.

Brian King, Director of the FDA’s Center for Tobacco Products, highlighted the implications for youth. King said unauthorized flavored e-cigarettes pose a public health concern, especially for young people. He noted that the proposed rule would strengthen enforcement regarding foreign manufacturers who attempt to sell illegal products in the U.S. King added that these manufacturers must comply with regulations or risk having their products blocked from entry.

Congress gave the FDA authority over tobacco products through the Tobacco Control Act of 2009. This act included provisions for registration and product listing requirements for all tobacco products sold or distributed in the U.S., regardless of origin.

The public comment period for this proposed rule will remain open until June 25, 2024. The FDA will review all submitted comments.
