Florida ranks as the state with the second-highest number of uninsured drivers in the nation, with nearly 25% of all drivers on the road operating without the state-required minimum insurance.

This staggering statistic means that approximately one in four drivers you encounter in Jacksonville, whether navigating the busy I-95 corridor or the historic Riverside neighborhood, may not have the necessary liability insurance. If you're involved in an accident with an uninsured driver and lack UM coverage, you could be left to cover all damages and expenses yourself. Serious accidents could lead to significant financial strain, including loss of your vehicle, major injuries, and substantial medical bills.

In Florida, UM/UIM can be used to pay for current and future medical expenses, disability costs, lost wages and benefits, pain and suffering, and future loss of earning potential.

Florida Statute 627.727 outlines the regulations for motor vehicle insurance, including UM/UIM provisions. This statute clarifies that if you are involved in an accident with an uninsured driver, your insurance will only compensate you if you have UM coverage. The coverage limits of a UM policy must at least match your bodily injury liability coverage. An uninsured motorist is defined as a driver at fault who cannot pay their legal liability and whose bodily injury limits are lower than the victim's damages. If an uninsured driver cannot pay, victims must send a written notice of settlement to their insurance company within 30 days to receive compensation. It's important to note that UM insurance typically excludes non-economic damages like pain and suffering unless they involve loss of bodily function, permanent scarring, permanent injury with a high degree of medical certainty, or death.
