The case centered on a then forty-eight-year-old plaintiff who sought dental extractions and dentures from a general dentist in October 1985. Crucially, the plaintiff provided a detailed medical history, which included information about squamous cell carcinoma of the left mandibular retromolar mucosa, treated with radiation in 1982. The plaintiff also supplied the names, addresses, and phone numbers of his physicians to the defendant dentist.

Despite this critical information, the defendant dentist reportedly did not contact either of the plaintiff’s physicians nor conduct any further investigation into his medical history. The dentist proceeded to extract twelve teeth, including a root fragment in the mandibular left molar region—an area directly within the path of the 1982 radiation treatment.

Two months following the extractions, dentures were inserted. Over the next three months, the plaintiff returned to the dentist four times, complaining that the lower left extraction socket had not healed and that he was experiencing a foul odor and taste. The defendant allegedly attributed these symptoms to “radiation infection” and assured the plaintiff they would improve over time.

However, eight months later, the plaintiff returned with advanced osteoradionecrosis, a severe condition requiring the resection of his mandible, which resulted in a discontinuity defect. Over the subsequent seven years, the plaintiff endured three bone grafts, a pectoralis myocutaneous flap, and other soft tissue grafts to address the extensive damage.

The plaintiff’s legal team argued that the defendant was negligent for failing to consult with or refer the plaintiff to an oral surgeon, for negligent extraction and improper monitoring, and for failing to obtain informed consent. The defense countered that a consultation or referral was unnecessary, that the extraction socket had fully healed, and that the plaintiff never voiced complaints about the socket. The defense also claimed the plaintiff’s failure to follow up with his cancer doctors and continued smoking and drinking habits constituted comparative negligence. Furthermore, the defense pointed fingers at the head and neck surgeon, radiation therapist, and hospital for not extracting the tooth prior to radiation, and at the reconstructive surgeon who operated after the osteoradionecrosis developed.

Following a two-week jury trial, a $2.96 million verdict was returned. This amount was subsequently reduced due to a five percent comparative negligence finding against the plaintiff and a twenty-five percent apportionment of fault against the hospital. Kenneth P. Liroff, D.D.S., J.D., was involved in the case, as noted in the original report.
