Pa. Court Rules State Constitution Guarantees Abortion Right, Ends Medicaid Ban

HARRISBURG, Pa. — In a landmark 4-3 decision Monday, the Pennsylvania Commonwealth Court ruled that the state constitution guarantees a right to abortion, overturning a 1982 law that prohibited Medicaid from covering the procedure except in cases of rape, incest or life endangerment. The seven-judge panel determined the ban violates fundamental reproductive autonomy, a protection now enshrined in Pennsylvania's charter for the first time.[1][2] Planned Parenthood and abortion clinic operators, who filed the initial lawsuit in 2019, hailed the victory as a major step for low-income patients across the state, where abortions remain legal through 23 weeks of pregnancy.[1][2] The case, argued by the Women's Law Project among others, contended that Pennsylvania's Medicaid restrictions discriminated against patients and providers. 'Today, our Commonwealth Court, looking at the Pennsylvania constitution, held that there is a right to reproductive autonomy, and it’s the highest possible level of a right,' said Susan Frietsche, executive director of the Women's Law Project.[1][2] The ruling aligns Pennsylvania with a handful of states where courts have safeguarded abortion rights through state constitutions post-Dobbs, amid ongoing national battles over reproductive care.[1] Pennsylvania's Medicaid program serves over 3 million residents, many in urban hubs like Philadelphia and Pittsburgh, where clinics have long shouldered unfunded abortion costs. The decision builds on a 2024 state Supreme Court reversal of a lower court ruling, which expanded scrutiny of constitutional anti-discrimination protections.[1][2] While the Shapiro administration did not immediately comment, anti-abortion groups signaled intent to appeal to the Democratic-controlled Supreme Court, potentially prolonging the fight into 2027.[1]
