Your Credit Card Rights: What To Do If You Have a Problem

Lake Mary residents navigating the complexities of credit card issues have specific rights and resources available to them. Understanding these protections can save time, money, and stress when disputes arise, whether it's an unauthorized charge from a local swipe at Colonial Town Center or a billing error.

The Fair Credit Billing Act (FCBA) is a federal law designed to protect consumers from unfair billing practices. This act applies to "open end" credit accounts, such as credit cards and revolving charge accounts. If you spot an error on your statement, such as a charge for something you didn't buy, a charge for the wrong amount, or a charge for goods or services you didn't accept, you have the right to dispute it.

To initiate a dispute, you must notify the creditor in writing within 60 days after the first bill containing the error was mailed to you. It's crucial to send your letter to the address specified by the creditor for "billing inquiries," not the address for payments. Clearly state your name, account number, and the specific error you believe occurred, along with the dollar amount.

Once your letter is received, the creditor must acknowledge it within 30 days. They then have two billing cycles (but no more than 90 days) to investigate the claim and either correct the error or explain why they believe the bill is accurate. During this investigation period, you are not required to pay the disputed amount or any finance charges on it, though you must pay any undisputed portions of your bill.

If the creditor determines there was an error, your account must be corrected, and you cannot be held responsible for the disputed amount or any related finance charges. If they find no error, they must explain their reasons in writing, and you will then owe the disputed amount, plus any accumulated finance charges.

Beyond billing errors, the FCBA also offers protections for unsatisfactory goods or services purchased with a credit card. If you've made a good-faith effort to resolve a problem with the merchant, you may have the right to withhold payment from the credit card issuer. This applies if the purchase was for more than $50 and occurred within your home state or within 100 miles of your current billing address, making it particularly useful for Lake Mary shoppers staying local or exploring nearby Seminole County spots.

For Lake Mary residents facing credit card issues, understanding these fundamental rights is the first step toward resolution. Keep detailed records of all communications, including dates, times, and names of people you speak with. If you believe your rights under the FCBA have been violated, you can report the issue to the Consumer Financial Protection Bureau (CFPB) or the Federal Trade Commission (FTC).
