Homestead Police Launch Dedicated Unit to Combat HOA and Condo Fraud

The Homestead Police Department established a specialized investigative unit to address fraud and misconduct within Homeowners Associations (HOAs) and Condominium Associations. This new unit aims to protect property owners and enforce transparency in local community governance.

This initiative responds to the growing need for oversight in HOA and condo operations, ensuring that residents have a clear avenue to report suspected criminal activity. While many HOA complaints are civil matters, the dedicated unit focuses on allegations of fraud and misconduct that fall within the scope of criminal investigation.

Property owners who suspect fraud or misconduct within their association can report it to the Homestead Police Department. Individuals must provide their name, email address, phone number, the association's name, email address, and phone number. They must also include a brief description of the criminal allegation and any supporting documentation that substantiates the complaint. Reports can be made on behalf of another person.

Florida State Statutes outline specific transparency requirements for associations. Condominium Associations with 150 or more units have been required since January 1, 2019, to post various documents on a website accessible to members. These documents include the Declaration of Condominium and its amendments, bylaws, articles of incorporation, association rules, contracts and bids, budgets and financial reports, director certifications, conflict of interest disclosures, meeting notices and agendas (posted 14 days prior), and documents for a vote (posted 7 days prior).

Homeowners Associations with 100 or more parcels will also face similar requirements. As of January 1, 2025, these HOAs must post relevant documents on their websites.
