Florida updates emergency management statutes, expanding governor's disaster response powers
The Florida Legislature has approved updates to state emergency management laws that expand and clarify the governor's authority during hurricanes, wildfires and other major disasters, according to recent revisions to Chapter 252 of the Florida Statutes.
The statutory changes codify procedures for declaring states of emergency and establish clearer protocols for coordinating disaster response between state and local governments. The updates also address how the state manages disaster relief resources during major emergencies.
Under the revised statutes, the powers of both Governor Ron DeSantis and the Division of Emergency Management have been clarified regarding their roles in responding to natural disasters and other emergencies that threaten public safety.
The legislative changes come as Florida continues to face recurring threats from hurricanes during the Atlantic storm season, as well as an increasing frequency of wildfires and other weather-related emergencies. The state's emergency management framework now has more clearly defined procedures for activating state resources when disasters strike.
The updated Chapter 252 provisions outline the process through which the governor can formally declare a state of emergency, a designation that typically allows for the mobilization of state resources, suspension of certain regulations, and activation of the Florida National Guard if necessary.
