Ballantrae HOA Amends Covenants for Easier Enforcement

The Ballantrae Homeowner's Association has updated its governing documents to simplify the process of addressing property owner delinquencies and violations. Homeowners approved the changes, which constitute the fifth amendment to the Declaration of Covenants, Conditions and Restrictions.
These amendments streamline the enforcement of liens, fines and leases for the HOA. Key revisions alter Article V, Section 8a, removing the subordination of a lien for Association Assessments from any mortgage, including those held by institutional lenders. This change prioritizes the HOA's claim for unpaid assessments over a mortgage in certain situations.
Article VIII, Section 3, now allows for broader penalties for violations. These can include suspending owners, tenants, guests and invitees from using common areas. The daily fine amount for ongoing infractions can also double, up to the maximum permitted by law.
Article VI, Section 1, Subsection FF, governing property leases, has also been significantly expanded. New requirements mandate submitting a lease in an Association-approved form at least seven days before the lease term begins, ensuring rental agreements comply with HOA regulations.
The Ballantrae HOA will mark its tenth anniversary in March 2013. The new Board of Directors has worked to update the community's governing documents to better address homeowners' needs and concerns. The revisions aim for compliance, not revenue generation.
