PHOENIX – An Arizona appeals court has vacated the sentencing of a man convicted in a road rage murder, citing remarks the trial judge made about an artificial intelligence-generated video. The video, which depicted the likeness of the slain victim, played during the sentencing hearing last year.

The three-judge panel of the Arizona Court of Appeals determined that Maricopa County Superior Court Judge Bruce Cohen committed judicial error. Judge Cohen stated during the sentencing that he "loved" the AI video presentation, according to court documents.

Elias Daniel Huizar received a sentence of 25 years to life in prison for the murder of Bryan Funston. Huizar shot Funston during a road rage incident in 2022. Prosecutors sought a sentence of life imprisonment for Huizar.

Funston's family created the AI video, which used his voice and image to deliver a posthumous statement. The video played as part of the victim impact statements during Huizar's sentencing.

Funston's family reported they created the AI video to allow Funston "to speak in his own words and likeness" at the sentencing. The technology involved cloning Funston's voice and using his image to animate a prepared statement.

Judge Cohen's comment about loving the AI video prompted the appeals court's decision. The court concluded that this remark compromised the appearance of judicial impartiality. The appeals court stated that Judge Cohen's comment indicated he considered factors beyond evidence presented in court.

The appeals court returned the case to the Maricopa County Superior Court for resentencing. A different judge will now oversee the new sentencing hearing for Huizar.
