FIU International Students Face Uncertainty Amid Blocked Immigration Rule Changes

Homestead’s Florida International University (FIU) international students are awaiting further guidance after a federal rule that would have significantly altered their immigration status was temporarily blocked. The U.S. Department of Homeland Security’s final rule aimed to replace the current 'Duration of Status' (D/S) system with fixed admission periods for F-1 students and J-1 exchange visitors.

The proposed rule would have assigned international students a fixed end date on their Form I-94, generally up to four years, based on their academic program length. This change was scheduled to take effect on September 15, but a nationwide preliminary injunction issued by a federal district court judge on September 14 temporarily postponed its implementation.

Impacts of the Proposed Fixed Admission Periods

Kelly Poppen, director of FIU’s International Student and Scholar Services, stated an appeal is likely. She advised institutions to prepare for the possibility of the regulation's implementation with little notice. If the rule takes effect, students needing more time in the United States beyond their authorized period would have to apply for an Extension of Stay through U.S. Citizenship and Immigration Services. This includes students requiring additional time to complete their degrees, pursue Optional Practical Training (OPT), or begin new educational programs.

The rule would also shorten the F-1 post-completion grace period from 60 days to 30 days for students entering or reentering the U.S. after the rule's effective date.

Ana Ramirez, an international student and junior at FIU, expressed immediate concerns about her post-graduation plans due to the proposed changes. The uncertainty surrounding the rule's potential implementation creates anxiety for students planning their academic and professional futures in the U.S.
