Orange County Releases Data Center NDAs After FOIA Challenge

The Orange County Board of Supervisors ordered the full release of two non-disclosure agreements tied to potential data center developers following a citizen's Freedom of Information Act request.

County staff initially withheld the agreements under Virginia Code § 2.2-3705.6(3), which exempts economic development records containing proprietary information supplied under confidentiality promises. After the interim legal counsel reviewed the withholding, the Board directed release of both NDAs in their entirety.

Orange County has received no data center development applications as of May 15, 2026.
